Privacy Policy

Sneez, LLC (“Sneez”, “us”, “we”, or “our”) operates the ZwellBeingTM web-based platform at survey.myzwellbeing.com (“Platform”) and mobile versions of the Platform (collectively, the “Service”). This Privacy Policy describes the information we collect about you and how it is shared or otherwise used, your rights and choices with regard to your information and how we secure your information.

This Privacy Policy applies to Personal Information collected by or on behalf of Sneez through the Service. Along with this Privacy Policy, please review our Terms of Use, which also govern your access to and use of the Service. By using the Service, you accept and consent to the terms of our Privacy Policy in effect at the time of your visit.

Please note, we are not a healthcare provider and the Service is not a medical or healthcare, mental, or behavioral health service; the Service is not intended to diagnose or treat any mental or physical health conditions. If you need medical care or treatment, you should contact your health care provider directly or call 911 if you feel like it is an emergency situation. 

When you choose to register for the Service, we will share your information in accordance with Paragraph 3 “Information We Share With Others.” 

1.) Information Collection and How We Use It

“Personal Information” is information that directly or indirectly identifies you or can be used to identify you as an individual.  The following are the categories of Personal Information we collect about you, depending on your use case and level of engagement with the Service, and how we collect it:

Information You Provide. We collect certain information that you provide when you use the Service. For example, in order to use the Service, you will need to register. As part of registration, we require your name, date of birth and mobile number. If you do not have a U.S. mobile number or you opt-in to email survey reminders, we will collect your email address as well. We use this information to provide the Service, to authenticate your identity and assign your user ID, and to send you reminders to complete questionnaires. By registering, you are giving us permission to ask you the questions contained in the ZwellCheck surveys that are presented to you and to share either subsequent de-identified aggregated information or more detailed information in accordance with the provisions of Paragraph 3 of the “Information We Share With Others” found below. Additionally, you are agreeing to the provisions of this Privacy Policy and the provisions in the Terms of Use.

Once you register, we collect your responses to the ZwellCheck questionnaires, which may include, but are not limited to, general information about your wellbeing, health, medical condition, mental or behavioral health, wellbeing in a work or school setting, social determinants of health, your current state of mind or feelings you may be experiencing, plus any additional ZwellChecks that may be developed. 

We also use your Personal Information to respond to your requests or inquiries or otherwise communicate with you about or through the Service; and to manage, protect and improve the Service. For example, if you agree to receive text messages, we will use your mobile number to send you reminders and alerts pertaining to your use of the Service.

Information Collected Automatically. We may automatically collect Personal Information about you when you visit or use the Service. For example, we automatically collect some information and data about your computer or mobile device when you visit or use the Service such as your IP address and browser type. We may also use your IP address to collect your general location. This information helps us improve the Service and provide information specific to your use of the Service. We may also aggregate Personal Information that we automatically collect in connection with your use of the Service, such that the information no longer identifies you individually. We may use and disclose such aggregated information for our business purposes.

  • Log Data: When you use the Service, we or our service providers, may use assorted technologies that automatically or passively collect information about how the Service is accessed and used. For example, when you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics (“Log Data”). Log Data is not intended to be personally identifying, but if we associate it with you as an identifiable person, we will treat it as Personal Information.
  • Cookies: In addition to Log Data, we, or our service providers, use cookies to collect information in order to improve the Service and to personalize your experience while using the Service. We use cookies to collect information in order to deliver and improve the Service. Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. Cookie data is also not intended to be personally identifying, but if we associate it with you as an identifiable person, we will treat it as Personal Information. You can instruct your browser to refuse all cookies, to delete cookies that have already been installed in your browser’s cookie folder or to indicate when a cookie is being sent. The help feature on most browsers provides information on how to accept cookies, delete or disable cookies or to notify you when receiving a new cookie. If you do not accept cookies, please be aware that you may not be able to use or access some features of the Service and some features and services of our Service may not work as intended.

We also use cookie data and Log Data to maintain and help diagnose problems with the Service and to help administer and audit usage of the Service. 

2.) Do Not Track Disclosure; Third-Party Tracking

The Service does not respond to Do Not Track (“DNT”) signals or messages and we do not presently have the capability to omit you from usage analytics to the extent that your browser or device sends us a DNT signal or message. DNT is a preference you can set in your web browser to inform websites that you do not want to be tracked. You may be able to enable or disable DNT by visiting the preferences or settings page of your web browser. Other than our service providers (such as our website analytics provider), we do not permit third-parties to track your activities overtime and across websites and the Service for purposes of promoting the third-party’s own products or services. That said, we cannot control third-party tracking and there may be some third-party tracking that occurs without our knowledge or consent.

3.) Information We Share with Others

A. Sponsor Organizations. 

(i) Subject to the provisions of Paragraphs A(ii) and B below, your responses will NOT be seen individually or be associated with you but will be anonymously aggregated and included in the total results of everyone else who took the same ZwellCheck survey as you within the entity procuring your access to the Service or the organizations acting on their behalf (“Sponsor Organization”), such as an employer or university administration; these de-identified, aggregated results will then be shared with the Sponsor Organization, as allowed by law.

(ii) Note, however, that, if the ZwellChecks are required as a condition of employment, for example, by your Sponsor Organization under occupational health and safety laws, such as those related to illness and COVID-19, your responses to these ZwellChecks may be visible to your Sponsor Organization. Please ask your Sponsor Organization if you have questions regarding the visibility or privacy of your ZwellCheck responses. 

B. Provider Organization as the Sponsor Organization. If your Sponsor Organization is an entity that provides healthcare or behavioral health services, or processes payments (claims) for such services, (“Provider Organization”) your responses to the ZwellCheck surveys on mental or physical health may be shared with your Provider Organization for your benefit as they work with you on your condition(s).  Please ask your Provider Organization if you have questions regarding the visibility or privacy of your ZwellCheck responses. 

C. Service Providers. We may disclose your Personal Information and other information described under this Privacy Policy to third-party service providers to facilitate the Service, to provide the Service on our behalf, to perform Service-related functions and/or to assist us in analyzing how the Service is used.

D. Business Transactions. If Sneez is involved in a merger, acquisition, reorganization, liquidation, change of control or sale, all information we collect, including your Personal Information, may be transferred as a business asset.

E. Required by Law; Investigations. We reserve the right to disclose any information we collect, including your Personal Information, as needed if that information is requested by law enforcement or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity. We also may disclose your Personal Information to third-parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us, including our Terms of Use.

4.) Security

We strive to implement and maintain commercially reasonable security for Personal Information we collect through the Service. However, please be aware that no method of transmission over the Internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we collect from you.

5.) Links to Other Sites

The Service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third-party’s site. We strongly advise you to review the privacy policy and practices of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

6.) Children’s Privacy

The Service is not directed to children under age 13. Only persons age 18 (or older if the age of majority is higher where they reside) have permission to use the Service. 

We do not knowingly collect Personal Information from children under age 13. If you are a parent or guardian and you learn that your child under age 13 has provided us with Personal Information, please contact us at contact@myzwellbeing.com. If we become aware that we have inadvertently collected Personal Information from a child under age 13, we will take steps to remove that information from our servers.

7.) Notice to Residents of Countries Outside the United States

We are headquartered in and the Service is operated in the United States. The Service is not targeted at individuals outside the United States. If you are located outside of the United States, be advised that any information we collect will be transferred to and stored in the United States, where the data laws may differ from those in the country in which you are located. By using the Service or providing Personal Information to us, you agree that the information will be transferred, processed, used and stored as set forth in this Privacy Policy and the laws of the United States.

8.) Changes to This Privacy Policy

We reserve the right to update or change this Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy through the Service will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

If you do not consent to the privacy practices as described in the revised version of the Privacy Policy, please do not use the Service in any manner. We will continue to treat previously collected information in accordance with the privacy practices described in the applicable, prior version of this Privacy Policy or as otherwise required by applicable law.
